  1. This website (“Website”) is owned and operated by Higgidy Limited, a company registered in England and Wales with company registration number 04754759 and whose registered office and principal place of business is at 60 Dolphin Road, Shoreham-by-Sea, West Sussex, BN43 6PB, United Kingdom.
  2. The terms “we”, “our” and “us” when used in this Privacy Policy means Higgidy Limited (“Higgidy”). The terms “you” and “your” when used in this privacy policy (“Privacy Policy”) means you as a user of the Website.
  3. Our Privacy Policy explains what information we gather about you and helps us ensure that you understand and consent to our uses of such information. Higgidy will keep your personal data safe, according to the General Data Protection Regulation 2016/679. Higgidy is registered with the Information Commissioner as a data controller.

We occasionally change our Privacy Policy we will notify you of any changes by posting them on this page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it. Please check our Privacy Policy regularly to ensure that you are aware of any changes.
  5. This Privacy Policy sets out the basis on which we will process any personal data we collect from you, or that you provide to us.
  6. Please note that the Website may from time to time contain links to and from other websites. If you follow a link to any of these websites please note that we are not responsible for the privacy practices or the content of such websites and the information practices of those websites are not covered by this Privacy Policy. Please check the individual privacy policy of any website that you visit before you submit any personal data to them.
  7. Please also note that when you engage with us on social media to contact us or find out more about our products, the personal data you supply is frequently subject to the privacy policy of that website, and therefore is not covered by the terms of Our Privacy Policy.

Information We May Collect and How We Use It

During the course of our activities we will process personal data (which may be held on paper, electronically, or otherwise) about our customers and we recognise the need to treat it in an appropriate and lawful manner, in accordance with the General Data Protection Regulation (GDPR). The purpose of this policy is to make you aware of how we will handle your personal data.

  1. “Personal data” means recorded information about you from which you can be identified. It may include your contact details, other personal information, photographs and IP addresses. It can also include expressions of opinion about you or indications as to our intentions about you.
  2. “Processing” means doing anything with the data, such as collecting, accessing, disclosing, destroying or using the data in any way.
  3. We collect the following information about you when you use this Website:

  • We may collect personal information (for example your name, email address and postal address, gender, date of birth) when you register for our newsletter or participate in a promotion we run on this website

    We will seek to keep the personal data we store about you accurate and up to date. Data that is known to be inaccurate or out of date will be deleted. However, it is your obligation to keep us informed of any changes to your personal data, eg if you move house, or if you become aware of any inaccuracies in the personal data we hold about you. You may do this by sending an email as indicated in section 24.

    We will not keep your personal data for longer than is necessary for the purpose. This means that data will be destroyed or erased from our systems when it is no longer required.

    We will only process your data in line with your data rights.

Your Consent

15. By using the Website and submitting information, you consent to:

  • The collection and use of your personal information by us as described in section 13 above
  • The sharing of your data with third parties in accordance with section 20 below

16. You have to right to:

  • Request access to any personal data we hold about you.
  • Prevent the processing of your data for direct-marketing purposes.
  • Ask to have inaccurate data held about you amended.
  1. To exercise any of these rights, please send us an email to the contact in section 24 with your full name and details and we will do our best to make the amendments as soon as possible. But do please understand that changes may not be immediate.
  2. We will ensure that appropriate measures are taken against unlawful or unauthorised processing of personal data, and against the accidental loss of, or damage to, personal data.
  3. We will ensure that we have in place procedures and technologies to maintain the security of all personal data from the point of collection to the point of deletion.

Information Disclosure to Third Parties

20. We may disclose your personal information to third parties in the following circumstances only:

  • For marketing purposes provided that we have had your direct consent to us sharing such data with third parties by notifying us via the Website or in other communications (e.g. by ticking the relevant box(es) on the Website at the point of registration)
  • To service providers who manage aspects of our operations (for example third parties who provide technical services to the Website) in connection with the Purposes
  • If Higgidy or substantially all of its assets are acquired by a third party, in which case personal data held by it about its consumers will be one of the transferred assets
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Website Terms and Conditions (located here)

21. Unless we have obtained your specific consent, we will never transfer your data to third parties for them to communicate directly with you. The only exception is where it is necessary to fulfil our obligations to you, for example to give a fulfilment company your address to send you a prize. But we will only transfer personal data if the other company agrees to comply with our data procedures and policies, and if they put in place adequate data security measures. Data Processors such as these are also bound to comply with the requirements as set out in the GDPR.

Your Rights – Marketing Communication

  1. You will only receive marketing communications from us and/or approved third parties if you have consented to this when you provided your contact details to us (or if you have otherwise submitted your consent to us for these purposes).
  2. You have the right to ask us not to use your personal data for marketing purposes. You can request that you stop receiving information from us or change your preferences at any time by emailing dataprotection@higgidy.co.uk.

Data Storage

  1. All information you provide to us is stored on our secure servers which are based within the EEA.
  2. The dynamics of the internet may mean that information is sent electronically to servers outside of the country where you originally entered the information. In addition, that information may be used, stored and processed outside the country where you entered that information. While there is a risk that countries to which information is transferred will not be subject to an information protection regime as rigorous as that of the UK and the EU, we will do our best to minimise this.
  3. By submitting your personal data, you agree to the transfer, storing or processing described in this Privacy Policy. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.
  4. Transmitting information via the internet can not be completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk. Once we receive your information, we use strict procedures and security features to try and prevent unauthorised access. Agents or contractors who in the course of providing services to Us have access to information which you give to us are required to keep that information secure and confidential and are not permitted to use it for any purpose other than to carry out the services which they are performing for Us and they, if they are Data Processors, are also bound to comply with the GDPR.

Collection and Use of Personal Information

In general, you can browse our website without giving us any personal information. However, there are additional activities on our site that require you to be registered. For example, to receive our monthly newsletter and enter some of our competitions. As part of that registration process, we collect personal information. We use that information for a couple of reasons: to tell you about stuff you’ve asked us to tell you about; to contact you if we need to obtain or provide additional information; to check our records are right and to check every now and then that you’re happy and satisfied.
